These Terms and Conditions govern your use of LIUNA Chat, a confidential communication platform operated by the New York State Laborers' Health & Safety Fund on behalf of LIUNA Upstate New York. By submitting the intake form or using the secure chat, you agree to these terms. If you do not agree, please do not use the platform.
LIUNA Chat is a union organizing support tool. It is designed to allow construction and solar workers in Upstate New York to communicate confidentially with LIUNA union organizers about workplace concerns, rights, and organizing activities. This platform is not a legal advice service, an emergency service, or a general-purpose communication tool. For immediate safety emergencies, call 911.
You agree to use LIUNA Chat only for its intended purpose: connecting with union organizers regarding workplace issues and labor rights. You agree not to: submit false, misleading, or deliberately harmful information; use the platform to harass, threaten, or harm any person; attempt to access the accounts or information of other users; or use the platform for any unlawful purpose.
By providing your phone number and checking the consent box on the intake form, you agree to receive text messages from LIUNA Upstate New York regarding your inquiry. Message and data rates may apply. Message frequency varies based on organizer response and your activity on the platform. To stop receiving text messages at any time, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message you receive. You will receive a final confirmation and no further messages will be sent. For help, reply HELP to any message. Not all mobile devices or carriers are supported; delivery is not guaranteed and is subject to your wireless carrier's network conditions.
You may delete all of your data — including your submission, all messages, and any associated contact information — at any time by using the "Delete My Data" option within the secure chat. Deletion is immediate and permanent. Additionally, submissions inactive for 90 or more days are automatically and permanently purged from our system.
Your use of LIUNA Chat and the content of your communications are confidential. Nothing submitted through this platform will be shared with your employer, job site management, or any representative of your employer. LIUNA Chat is operated solely for the benefit of workers, not employers.
LIUNA Chat is provided on an "as-is" basis without warranties of any kind, express or implied. We do not guarantee that the platform will be available at all times, that messages will be delivered without delay, or that any particular outcome will result from your use of the platform. Delivery of SMS messages depends on your wireless carrier and is outside our control.
To the fullest extent permitted by applicable law, the New York State Laborers' Health & Safety Fund and LIUNA Upstate New York shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, LIUNA Chat.
These Terms and Conditions are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the appropriate courts located in New York State.
We may update these Terms and Conditions from time to time. Updated terms will be posted to this page with a revised effective date. Continued use of the platform after changes are posted constitutes your acceptance of the updated terms. These terms apply solely to the LIUNA Chat platform and do not affect any other agreements between you and LIUNA.
